Cleaning of communal areas
The weekly clean takes place on a Monday by Mark and Leonie Fraser from ‘Marks Off’. Owners should contact the factor if they have any concerns or problems regarding cleaning.
Consideration for others
New Cut Rigg is a pleasant and quiet development. If you are smoking outside the building, please make sure not to leave cigarette ends lying around.
If you are being disturbed in your home by noise, you should, in the first place, try to discuss the matter with your neighbour. If the situation does not improve, you should contact the police on 101 when the noise is happening. The kinds of noise could be
- neighbours playing loud music or having parties
- neighbours banging or shouting
- washing machines/dishwashers being used late at night
- barking dogs
The control centre for Police Scotland operates on 101 at any time of the day and for 7 days per week. Once you have contacted the Police, an officer will be in contact with you to discuss the matter further. If you have any of the above problems and wish to seek advice, you should contact Edinburgh City Council and ask to speak to a Community Safety Officer.
Street lighting
The lamp-posts to the front of both buildings are the property of Edinburgh City Council and faults with these should be reported here, either online or by telephone. The lighting to the rear of the buildings on the parts of road that are private (they do not have the council numbering on the posts) belong to New Cut Rigg. Faults here should be reported to the factor.
Front and rear doors to each stair
Please ensure that doors are shut and locked when you leave. Each door is self-closing but on occasion, due to wind or a need for the mechanism to be oiled, this does not happen. You should also refrain from leaving the door on the snib as this is not sufficiently secure.
Lift
Some owners have a key for the lift that allows the lift door to be kept open – e.g. in removals or if the lift is broken/the door banging . These keys can be copied but they are expensive.
Residents are asked to take care when using the lifts to transport bulky items and to make sure that the lift is left clean and tidy after using it to transport bulky/messy items.
Lightbulbs
Each stair has its own policy on replacing lightbulbs and new owners/tenants should ask the stair rep how this is dealt with. Some stairs have their own supply, bought communally, while others use the factor to replace light bulbs and pay the charge resulting from this.
TV/Satellite dishes
As per the title deeds for the properties, no satellite dishes are permitted within the development. For new owners/tenants, this means ensuring that your TV is compliant with Freeview, not FreeSat, or that you subscribe to an appropriate cable TV provider. Once again, liaising with the stair rep or other neighbours might be beneficial here.
Key Boxes
Key boxes are only permitted for health care reasons and where there is more than one user in a stair, they are encouraged to share the external key box and have a separate key box at their flat door. Recently several redundant key boxes were removed, thereby improving the overall appearance at the entrance to each stair.
Short Term Lets
The title deeds for the properties (the Deed of Conditions) provide that our flats are used only as private dwellings, are not occupied by more than one family at a time and are not used for carrying on a business. At the AGM in 2023, it was agreed that these provisions apply to Short Term Letting and there should be no Short Term Letting at New Cut Rigg.
Further, planning permission is required for a change of use from Residential to Short Term Letting, which Edinburgh Council have made known will not be granted in buildings with common access stairs. An application for such a change of use has been made and refused on appeal at New Cut Rigg, with an enforcement order served.
Finally, there is a requirement in Edinburgh for a Licence to operate a Short Term Let, which would only be considered if planning permission had previously been granted.
Accordingly, New Cut Rigg should not suffer the nuisance and disturbance resulting from Short Term Lets.
